Section 27

Jurisdiction

(1) The civil chambers of the regional courts have exclusive jurisdiction, regardless of the amount in dispute, for all actions by which a claim from one of the legal relationships governed by this Act is asserted (utility model litigation).
(2) The Land governments are authorised to assign, by statutory instrument, the utility model litigation for the districts of several regional courts to one of them, where this serves the effective conduct of the proceedings. The Land governments may transfer this authorisation to the Land justice administrations. The Länder may further, by agreement, transfer duties incumbent on the courts of one Land, in whole or in part, to the competent court of another Land.
(3) Of the costs arising from the involvement of a patent attorney in utility model litigation, the fees under section 13 of the Act on the Remuneration of Lawyers, as well as the necessary disbursements of the patent attorney, are to be reimbursed.
