(1) The subject matter of a utility model is deemed new if it does not form part of the state of the art. The state of the art comprises all knowledge that has been made available to the public, before the day decisive for the priority of the application, by means of a written description or by use within the territorial scope of this Act. A description or use occurring within six months before the day decisive for the priority of the application is disregarded where it is based on work by the applicant or the applicant's predecessor in title.
(2) The subject matter of a utility model is deemed industrially applicable if it can be manufactured or used in any industrial field, including agriculture.
