Immediate Enforceability

An objection and an action for annulment against measures of BaFin, including the threat and imposition of coercive means, on the basis of section 4(2), sections 4b, 7, 8, 13(2), nos. 2 to 5, or section 14(1) in conjunction with section 2c(1b), first to third sentences, (2), first sentence, and (2a) of the Banking Act, on the basis of section 15(1), third and fourth sentences, (2), third sentence, sections 19 to 21, these also in conjunction with section 17(3), third sentence, section 23(1), section 24(4), or on the basis of section 25(3), section 26(3) and (3a) or section 27(3), first and third sentences, or (4), second sentence, or section 32(2), or section 39(8), have no suspensive effect.
