Submission of Annual Financial Statements, Management Report and Audit Reports

(1) An institution must draw up its annual financial statements for the past financial year within the first three months of the financial year, and must submit the annual financial statements, once drawn up and later once adopted, and the management report, to BaFin and to the Deutsche Bundesbank without delay in each case. The annual financial statements must bear the auditor's certificate or a note that the certificate was refused. The auditor must submit the audit report on the audit of the annual financial statements (audit report) to BaFin and to the Deutsche Bundesbank without delay after completion of the audit.
(2) An institution that draws up consolidated financial statements or a group management report must submit these documents to BaFin and to the Deutsche Bundesbank without delay. Where an audit report is drawn up by a group auditor, that auditor must submit the audit report to BaFin and to the Deutsche Bundesbank without delay after completion of the audit. The provisions of this subsection apply correspondingly to separate financial statements under section 325(2a) of the Commercial Code.
