(1) An account servicing payment service provider may deny an account information service provider or a payment initiation service provider access to a payment account where objective and duly evidenced reasons relating to unauthorised or fraudulent access by the account information service provider or the payment initiation service provider to the payment account, including the unauthorised or fraudulent initiation of a payment transaction, justify this.
(2) In the cases under subsection (1), the account servicing payment service provider must report the incident to BaFin without delay. The report must state the details of the incident and the reasons for taking action. BaFin must evaluate the case and may take suitable measures where necessary. The tasks and competences of other authorities, in particular the competition authorities under the Act against Restraints of Competition and the prosecuting authorities under the Code of Criminal Procedure, remain unaffected.
(3) The account servicing payment service provider must grant access to the payment account as soon as the reasons for denying access no longer exist.
