(1) Where the payer gives explicit consent to the execution of a payment, the account servicing payment service provider is required to 1. communicate with the payment initiation service provider in a secure manner, 2. immediately after receipt of the payment order from a payment initiation service provider, provide or make available to it all information on the initiation of the payment transaction and all information accessible to the account servicing payment service provider regarding the execution of the payment transaction, and 3. treat payment orders transmitted through a payment initiation service provider, in particular as regards timing, priority or fees, in the same way as payment orders transmitted directly by the payer, unless there are objective reasons for different treatment.
(2) The provision of payment initiation services does not depend on the payment initiation service provider and the account servicing payment service provider having entered into a contract for that purpose.
