The card-issuing payment service provider may request the account servicing payment service provider to give the confirmation under section 45(1) where the payer 1. has given the card-issuing payment service provider explicit consent to this in advance, and 2. has initiated the card-based payment transaction for the relevant amount using a card-based payment instrument issued by the card-issuing payment service provider. The card-issuing payment service provider must authenticate itself to the account servicing payment service provider before every individual request for confirmation, and communicate with it in a secure manner. The card-issuing payment service provider may not store the answer under section 45(2), or use it for purposes other than the execution of the card-based payment transaction.
