Competence of the Higher Regional Court in court proceedings

(1) In court proceedings concerning a regulatory offence under section 60, the Higher Regional Court competent for BaFin's seat in Frankfurt am Main decides; it also decides on an application for a court decision (section 62 of the Act on Regulatory Offences) in the cases of section 52(2), third sentence and section 69(1), second sentence of the Act on Regulatory Offences. Section 140(1), no. 1 of the Code of Criminal Procedure in conjunction with section 46(1) of the Act on Regulatory Offences does not apply.
(2) The Higher Regional Court decides with a bench of three members including the presiding member.
