Oral hearing

(1) The appellate court decides on the appeal on the basis of an oral hearing; with the consent of the parties, a decision may be made without an oral hearing.
(2) Where the parties have failed to appear, or are not duly represented, at the hearing despite timely notice, the matter may nevertheless be heard and decided.
