Section 51

Period and form

(1) The appeal must be lodged in writing with the appellate court within a peremptory period of one month. The period begins with the notification or service of BaFin's objection decision.
(2) Where no order is issued on an application, the appeal is not bound by any period.
(3) The appeal must be reasoned. The period for the statement of grounds of appeal is one month; it begins with the lodging of the appeal and may be extended, on application, by the presiding member of the appellate court.
(4) The statement of grounds of appeal must contain 1. a declaration of the extent to which the order is contested and its amendment or setting-aside sought, and 2. a statement of the facts and evidence on which the appeal is based.
