Special commissioner

(1) To monitor compliance with orders under section 79(1) and (2), the Bundesanstalt may appoint a special commissioner. The special commissioner is, within the scope of that task, entitled to
1. require information and the production of documents from members of the governing bodies and employees of the securities institution;
2. take part in all meetings and sessions of the governing bodies and other committees of the securities institution;
3. enter the business premises of the securities institution;
4. inspect the business papers and books of the securities institution; and
5. make inquiries. The special commissioner must notify the Bundesanstalt without delay of breaches of an order under section 79(1) and (2) that have occurred.
(2) The costs arising from the appointment of the special commissioner, including the reasonable expenses to be granted and the remuneration, are borne by the securities institution. The Bundesanstalt sets the amount of the remuneration. The Bundesanstalt advances the expenses and remuneration on application of the special commissioner.
(3) The special commissioner is liable, within the scope of that task, only for intent.
