(1) A person who intends to act domestically as a data reporting services provider on a commercial basis, or on a scale that requires a commercially organised business undertaking, requires written or electronic authorisation from the Bundesanstalt under Article 27b(1), second subparagraph of Regulation (EU) No 600/2014; the Bundesanstalt must apply section 37(4) of the Administrative Procedure Act.
(2) The required content of the authorisation application, its form, and the authorisation procedure, are governed by Articles 27c and 27d of Regulation (EU) No 600/2014, Delegated Regulation (EU) 2017/571, and Implementing Regulation (EU) 2017/1110.
(3) The Bundesanstalt may grant the authorisation subject to conditions that must remain within the scope of the purpose pursued by this Act or by Regulation (EU) No 600/2014.
(4) Exceptions from the requirement for authorisation as a data reporting services provider arise from Article 27b(2) and Article 27c(4) of Regulation (EU) No 600/2014.
