Refusal of authorisation; withdrawal of authorisation

(1) Authorisation as a data reporting services provider must be refused where 1. facts exist showing that a manager does not satisfy the requirements of Article 27f(1) of Regulation (EU) No 600/2014, also in conjunction with Delegated Regulation (EU) 2017/571; or 2. the undertaking is not willing or able to make the personnel or organisational arrangements necessary, under Title IV of Regulation (EU) No 600/2014, also in conjunction with the legal acts issued under it, for the orderly conduct of the services for which it applies for authorisation.
(2) The Bundesanstalt may, apart from under the provisions of the Administrative Procedure Act, withdraw an authorisation it has granted, under Article 27e(1) of Regulation (EU) No 600/2014.
