Supervisory measures; prohibition of operation

(1) In addition to the functions arising from Regulation (EU) No 910/2014, the supervisory body is also responsible for supervising compliance with this Act and with the statutory ordinance under section 20.
(2) The supervisory body may take the measures necessary against trust service providers to ensure compliance with this Act and with the statutory ordinance under section 20. To ensure compliance with this Act and with the statutory ordinance under section 20, it may request evidence from trust service providers and carry out its own inspections. In addition, the measures available under Regulation (EU) No 910/2014, in particular under Article 17(4), are also available to the supervisory body for enforcing this Act and the statutory ordinance under section 20.
(3) The supervisory body may temporarily, partially or fully prohibit a trust service provider from operating where
1. measures under Article 17(4)(j) of Regulation (EU) No 910/2014 offer no prospect of success, and
2. facts justify the assumption that the provider does not satisfy the requirements for operating a trust service under Regulation (EU) No 910/2014, this Act, and the statutory ordinance under section 20.
