(1) The Bundesnetzagentur shall, upon application, designate an organisation as a private body under Article 30(1) of Regulation (EU) No 910/2014 and under Article 39(2) in conjunction with Article 30(1) of Regulation (EU) No 910/2014, provided that the accreditation body under section 1(1) of the Accreditation Body Act has, by way of accreditation, determined that the private body satisfies the necessary requirements. The designation may 1. be limited in scope, granted provisionally, or granted for a limited period, and 2. be subject to conditions.
(2) For as long as the European Commission has not adopted delegated acts under Article 30(4) of Regulation (EU) No 910/2014, 1. the accreditation body shall establish and publish the technical criteria to be satisfied for accreditation, and 2. the Bundesnetzagentur shall establish and publish the technical criteria to be satisfied for designation as a private body under Article 30(1) of Regulation (EU) No 910/2014. The technical criteria shall be established having significant regard to the Commission Decision of 6 November 2000 on the minimum criteria to be taken into account by Member States when designating bodies in accordance with Article 3(4) of Directive 1999/93/EC of the European Parliament and of the Council on a Community framework for electronic signatures (OJ L 289, 16.11.2000, p. 42).
(3) A body recognised under section 17(4) sentence 1 of the Signature Act in conjunction with section 18 of the Signature Act shall continue to perform its associated functions in respect of the products it confirmed on the basis of the Signature Act, until the expiry of the corresponding product confirmations.
(4) The Federal Office for Information Security is the public body under Article 30(1) of Regulation (EU) No 910/2014 and under Article 39(2) in conjunction with Article 30(1) of Regulation (EU) No 910/2014.
