Authorisation to issue an ordinance

(1) The Federal Government shall, by statutory ordinance, lay down more detailed requirements for making trust services accessible and usable under Article 15 of Regulation (EU) No 910/2014 and under section 7. In doing so it must take into account technical and economic considerations. The statutory ordinance may also contain evidentiary, cooperation and information obligations of trust service providers.
(2) The Federal Government is authorised to also enact, in the statutory ordinance under subsection (1), the legal provisions necessary to implement Regulation (EU) No 910/2014 and this Act, concerning
1. the design of trust service providers' obligations on commencement of operation, during operation, and on cessation of operation under Articles 17 to 24 of Regulation (EU) No 910/2014 and under sections 4 and 5, 9 to 18,
2. the conduct of joint investigations under Article 18(3) of Regulation (EU) No 910/2014,
3. the forms of security permissible for satisfying the financial-cover obligation under section 10, as well as their scope, amount and substantive design,
4. the requirements relating to a certificate database under section 16(4) number 1,
5. the establishment of a trust infrastructure for the permanent verifiability of qualified electronic certificates and qualified electronic time stamps under section 16(5), and
6. the details of the procedure for the recognition and activity of certification bodies under section 17.
