Reporting of infringements; authorisation to issue statutory instruments

(1) BaFin establishes a system for receiving reports of potential or actual infringements of statutes, statutory instruments, general orders and other provisions, as well as regulations and directives of the European Union, where it is BaFin's task to ensure compliance by the undertakings and persons it supervises, or to penalise infringements of them. Reports may also be made anonymously. They may be made in English.
(2) The Federal Ministry of Finance may, by statutory instrument not requiring the consent of the Bundesrat, issue detailed provisions on the content, type, extent and form of reports of infringements for which BaFin is competent under subsection (1) and section 21 of the Whistleblower Protection Act, including the statutory instruments, general orders and other provisions, and regulations and directives of the European Union, covered by subsection (1). The Federal Ministry of Finance may transfer the authorisation, by statutory instrument, to BaFin.
