Separate reimbursement for separate examinations

The costs incurred by BaFin through performing the tasks under section 108(1), second sentence, no. 1 of the Securities Trading Act must be separately reimbursed to it by the undertakings within the meaning of section 106 of the Securities Trading Act, and advanced to it on request. No separate reimbursement of costs incurred through performing the tasks under section 108(1), second sentence, no. 1 of the Securities Trading Act takes place where BaFin's examination result deviates from the Enforcement Panel's examination result in favour of the undertaking concerned. The costs under the first sentence also include the costs with which BaFin is charged by the Enforcement Panel in the course of its activity under section 107(4) of the Securities Trading Act, or by other bodies acting for BaFin in the course of such measures, as well as the costs of deploying its own staff. The Ministry is authorised to determine details of the separate reimbursement by statutory instrument. The Ministry may transfer the authorisation, by statutory instrument, to BaFin.
