(1) Where a commission agent (sections 383, 406 of the Commercial Code) executes an order for the purchase of securities, it must send the principal, without delay and at the latest within one week, a list of the securities purchased. In the list of securities, the securities are to be designated by class, nominal amount, numbers or other identifying features.
(2) The period for sending the list of securities begins, where the commission agent named a third party as seller in the notice of execution of the order, with the acquisition of the certificates, and otherwise begins with the expiry of the period within which the commission agent could, following the notice of execution and in the ordinary course of business without culpable delay, have obtained the certificates, or could have received the list of securities from a third party designated for their safekeeping.
(3) On the dispatch of the list of securities, ownership of the securities designated in it passes to the principal, insofar as the commission agent is entitled to dispose of them, where it has not already passed to the principal earlier under the provisions of the civil law.
