Exchange custody

(1) A declaration by which the depositor authorises the custodian to return securities of the same kind instead of the securities entrusted to it for safekeeping must be given expressly and in text form for the particular custody transaction. It may neither be contained in the custodian's terms of business nor refer to other documents.
(2) The same form is required for a declaration by which the depositor authorises the custodian to replace deposited securities with securities of the same kind.
