Exemption from formal requirements

The formal requirements of section 4(2), section 5(1), second and third sentences, and sections 10, 12, 13 and 15(2) and (3) do not apply where the custodian is subject to statutory supervision and the depositor is a merchant who
1. is entered in the commercial register or the register of cooperatives, or
2. in the case of a legal person under public law, need not, under the statutory rules applicable to it, be so entered, or
3. is not entered because it has its seat or principal establishment abroad.
