(1) For registered associations under section 21 of the Civil Code, the register-keeping body shall, on the basis of the data entered in the Register of Associations, create an entry in the Transparency Register without any notification under section 20(1), first sentence being required for that purpose. In the course of that entry, all members of an association's executive board are recorded in the Transparency Register, with the data under section 19(1), as beneficial owners under section 3(2), fifth sentence. Insofar as such data are not available in the Register of Associations, Germany is assumed as the country of residence and German nationality as the sole nationality. The data entered under the first sentence are deemed to be information provided by the association, insofar as the association has not notified the register-keeping body of differing information.
(2) By way of derogation from section 20(1), first sentence, a registered association under section 21 of the Civil Code need only notify the register-keeping body of the information listed in section 19(1) on its beneficial owners for entry where
1. a change to the executive board has not been notified without delay for entry in the Register of Associations,
2. at least one beneficial owner under section 3(2), first to fourth sentences exists, or
3. the assumptions under subsection (1), third sentence are not correct. An entry by the register-keeping body under subsection (1) is not made where the association has notified the register-keeping body of information under section 19(1) for entry in the Transparency Register. This does not apply where the association has notified the register-keeping body that the information notified under section 19(1) is no longer to apply. The notification under the third sentence must be made electronically via the website of the Transparency Register.
(3) An entry under subsection (1) shall first take place no later than 1 January 2023. Thereafter, the automatic entry shall be made as circumstances require.
(4) In making an entry under subsection (1), the register-keeping body acts under section 18(2) within the sovereign tasks of the Federation. For this purpose the register-keeping body is exempt from payment of the fees under section 2(1) of the Judicial Administration Costs Act when retrieving data from the Registers of Associations.
