Section 19b

Recording and Attribution of Real Property

(1) The land registries shall transmit to the register-keeping body the following information on all land register folios kept by them: 1. the competent local court, 2. the land registry district, 3. the number of the land register folio, 4. all plots of land listed in the register of the land register folio, each with a) parcel district, b) survey district and c) parcel number, 5. all owners listed in Part I, each, where available, with a) name or business name, b) registered office, c) court of registration, d) type of register, e) registration number, and f) date of entry. Transmission shall take place on the basis of already available structured data. It shall take place on a one-off basis no later than 31 July 2023, with data as at 30 June 2023.
(2) From 1 July 2023, the land registries shall transmit to the register-keeping body, by an automated procedure, changes to the land-register description of the plot of land and the entry of an owner. Transmission shall take place in a structured data format on the basis of already available structured data.
(3) The register-keeping body shall, on the basis of the information transmitted to it from the land registers, record the information under section 19a in respect of real property, attribute it to associations under section 20(1), and store it. Transmitted data that are not necessary for this purpose shall be deleted by the register-keeping body without delay.
(4) By way of derogation from subsections (1) and (2), the Länder may provide for transmission of the data by the authorities responsible for maintaining the real property cadastre. The land registries and the authorities responsible for maintaining the real property cadastre may enter into agreements with the register-keeping body on the data format to be used.
