Information on the Beneficial Owner

(1) In respect of associations under section 20(1), first sentence and legal arrangements under section 21, the following information on the beneficial owner shall be accessible in the Transparency Register in accordance with section 23:
1. first and last name,
2. date of birth,
3. place of residence,
4. the nature and extent of the beneficial interest, and
5. all nationalities.
(2) For determining the beneficial owner of associations within the meaning of section 20(1), first sentence, other than foundations with legal capacity, section 3(1) and (2) applies correspondingly. For determining the beneficial owner of legal arrangements under section 21 and of foundations with legal capacity, section 3(1) and (3) applies correspondingly.
(3) The information on the nature and extent of the beneficial interest under subsection (1), no. 4 shall show the basis of the status as beneficial owner, namely
1. for associations under section 20(1), first sentence, other than foundations with legal capacity, from
a) a holding in the association itself, in particular the amount of capital interests or voting rights,
b) the exercise of control in some other manner, in particular on the basis of arrangements between a third party and a shareholder or between several shareholders, or on the basis of the power conferred on a third party to appoint statutory representatives or other members of a corporate body, or
c) the function of statutory representative, managing partner or partner, and
2. for legal arrangements under section 21 and foundations with legal capacity, from one of the functions listed in section 3(3). In the cases under the first sentence, no. 1, letter c), it shall be stated whether it was established that no natural person satisfies the conditions of a beneficial owner under section 3(1) or subsection (2), first to fourth sentences, or whether establishing a beneficial owner under section 3(1) or subsection (2), first to fourth sentences was not possible after comprehensive checks were carried out.
