Transmission of the securities information sheet to the Bundesanstalt; deadline and form of publication; publication by the Bundesanstalt

(1) The securities information sheet must be transmitted to the Bundesanstalt electronically and in an electronically searchable format via its reporting and publication system.
(2) Section 22(2) applies accordingly to the retention of the securities information sheet and of updated versions.
(3) The deposited securities information sheet must be published at least one working day before the public offer, in accordance with Article 21(2) and (3), first subparagraph of Regulation (EU) 2017/1129. The offeror must ensure that the securities information sheet is accessible to everyone without restriction of access; the provisions of Article 21(4) of Regulation (EU) 2017/1129 apply accordingly.
(4) The Bundesanstalt publishes on its website the securities information sheets permitted under section 4. These remain publicly accessible on the website for ten years. The Bundesanstalt also publishes on its website the updated versions of securities information sheets transmitted under section 4(8), first sentence; the second sentence applies accordingly.
