Measures in the event of infringements

(1) In the event of an infringement of the provisions named in section 24(1), (3) or (4), the Bundesanstalt may, to prevent further infringements,
1. publish an announcement of the infringement on its website in accordance with the requirements of Article 42 of Regulation (EU) 2017/1129, naming the natural or legal person or association of persons that committed the infringement, and the type of infringement, and
2. order the natural or legal person or association of persons responsible for the infringement to permanently discontinue the acts or conduct constituting the infringement.
(2) In the event of an infringement of the provisions named in section 24a(2) or (3), the Bundesanstalt may, to prevent further infringements,
1. publish an announcement of the infringement on its website in accordance with the requirements of Article 52 of Regulation (EU) 2023/2631, naming the natural or legal person or association of persons that committed the infringement, and the type of infringement,
2. order the natural or legal person or association of persons responsible for the infringement to announce the infringement, and the type of infringement, on its own website,
3. order the natural or legal person or association of persons responsible for the infringement to permanently discontinue the acts or conduct constituting the infringement, and
4. prohibit the natural or legal person or association of persons responsible for the infringement from making a public offer of European Green Bonds for a period of up to one year.
(3) The announcement under paragraph 1 no. 1 and paragraph 2 no. 1 may contain only such personal data as are necessary to identify the offeror or issuer. The announcement under paragraph 1 no. 1 and under paragraph 2 no. 1 must be deleted after five years.
