(1) The sales prospectus must be published at least one working day before the public offer, in accordance with subsection (2), first and second sentences.
(2) The sales prospectus must be published in such a way that it is
1. published on the offeror's website and in the Federal Gazette, or
2. published on the offeror's website and kept available free of charge at the paying agents named in the sales prospectus; this must be announced in the Federal Gazette. Where asset investments are offered through an electronic information dissemination system, the sales prospectus must also be published there; the offer must indicate the reference in the electronic information dissemination system. The offeror must communicate the date and place of publication to BaFin without delay, electronically, through its notification and publication system.
(3) BaFin publishes on its website the sales prospectuses approved under section 8. These remain publicly accessible on the website for ten years. BaFin also publishes on its website supplements to sales prospectuses under section 14(3), first sentence; the second sentence applies accordingly.
