Notification and service

(1) BaFin must give notice of orders issued against a person domiciled abroad, or an undertaking with its seat abroad, to the person named as authorised representative. Where no authorised representative domiciled in Germany has been named, notice is given by public announcement in the Federal Gazette.
(2) Where an order is to be served, service on persons domiciled abroad, or undertakings with their seat abroad, is effected on the person named as authorised representative. Where no authorised representative domiciled in Germany has been named, service is effected by public announcement in the Federal Gazette.
(3) An issuer of asset investments with its seat abroad must name to BaFin an authorised representative domiciled in Germany, to whom notices under subsection (1) and service under subsection (2) can be effected. The naming must be made at the same time as the sales prospectus is submitted for approval under section 8.
