(1) BaFin publishes decisions imposing fines under section 29 on its website without delay after they become final, where this is warranted, weighing the interests concerned, to remedy or prevent abuses. BaFin refrains from publication in particular where publication would be disproportionate on account of the minor significance of the infringement underlying the decision imposing the fine.
(2) The publication must name the provision that was infringed and the natural or legal persons identified as responsible. BaFin publishes on an anonymous basis where a non-anonymised publication would infringe the personal rights of a natural person or would otherwise be disproportionate. BaFin republishes without delay, naming the natural or legal persons, where the reasons for anonymous publication have ceased to apply.
(3) BaFin defers the publication for as long as publication would endanger the conduct of criminal, regulatory-fine or disciplinary investigations, or the stability of the financial markets of the Federal Republic of Germany or of one or more states of the European Economic Area.
(4) The publication must be deleted at the latest after five years.
