Prohibition of publication

(1) BaFin prohibits the publication of the sales prospectus where it does not contain the particulars required under section 7(1) and (2), including in conjunction with the statutory instrument to be issued under section 7(3), or where those particulars are not coherent or not comprehensible. BaFin prohibits, in accordance with section 8(4), fourth sentence, the publication of the sales prospectus and the associated asset investment information sheet where it has issued a prohibition, under section 15 of the Securities Trading Act, of the asset investment underlying the sales prospectus.
(2) BaFin prohibits the publication of the sales prospectus where it has indications that the offeror, contrary to section 14(1), second sentence in conjunction with section 13(1), has not deposited an asset investment information sheet with BaFin.
(3) BaFin prohibits the publication of the asset investment information sheet where it does not contain the particulars and notices required under section 13, including in conjunction with the statutory instrument to be issued under section 13(8), or where the particulars and notices are not given in the prescribed order.
