Prohibition on interception; duty of confidentiality of operators of radio equipment

(1) Radio equipment (section 3(1) no. 1 of the Radio Equipment Act) may be used to intercept or otherwise take cognisance of only such messages as are intended for the operator of the radio equipment, for radio amateurs within the meaning of section 2 no. 1 of the Amateur Radio Act, for the public generally, or for an indeterminate group of persons.
(2) The content of messages other than those referred to in paragraph 1, and the fact of their reception, may not be disclosed to others, even where reception occurs unintentionally, including by persons not already subject to a duty of confidentiality under section 3. Section 3(4) applies accordingly.
(3) Interception or comparable taking of cognisance, and the disclosure, of messages carried out on the basis of specific statutory authorisation remain unaffected.
