Jurisdiction, tasks and powers of the Federal Network Agency

(1) The Federal Network Agency is the competent supervisory authority for compliance with the provisions of Part 2, insofar as the Federal Commissioner for Data Protection and Freedom of Information is not responsible under section 29.
(2) The Federal Network Agency may issue orders and take other measures to ensure compliance with the provisions of Part 2. The person under a duty pursuant to the provisions of Part 2 must, on request by the Federal Network Agency, provide the information necessary for this purpose. The Federal Network Agency is authorised, for the purpose of verifying compliance with the duties, to enter and inspect business and operational premises during the usual operating or business hours.
(3) Beyond the power to issue orders under paragraph 2, the Federal Network Agency may, in the event of non-compliance with duties under Part 2, wholly or partly prohibit the operation of the telecommunications installations concerned, or the provision of the telecommunications service concerned, where milder measures are not sufficient to enforce lawful conduct.
(4) To enforce measures and orders under paragraphs 2 and 3, a coercive fine of up to 1 million euros may be imposed in accordance with the Administrative Enforcement Act.
(5) The secrecy of telecommunications under Article 10 of the Basic Law is restricted insofar as the exercise of the powers under paragraph 2, first and third sentences requires it.
