(1) The definitions in the Telecommunications Act, the Digital Services Act, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), also apply for the purposes of this Act, insofar as paragraph 2 does not provide a differing definition.
(2) For the purposes of this Act: 1. "provider of digital services" means any natural or legal person who provides digital services of their own or of another, participates in providing such services, or mediates access to the use of digital services of their own or of another; 2. "subscriber data" for the purposes of Part 3 of this Act means personal data whose processing is necessary for the purpose of establishing, defining the content of, or amending a contractual relationship between the provider of digital services and the user concerning the use of digital services; 3. "usage data" means the personal data of a user of digital services whose processing is necessary to enable and to bill for the use of digital services; this includes in particular a) characteristics for identifying the user, b) particulars of the beginning and end, and of the extent, of the respective use, and c) particulars of the digital services used by the user; 4. "message" means any information exchanged or conveyed between a finite number of parties by means of a telecommunications service; excluded from this are items of information conveyed to the public as part of a broadcasting service over a public telecommunications network, insofar as the information cannot be related to the identifiable user receiving it; 5. "value added service" means any additional service provided by a provider of a telecommunications service that requires the processing of traffic data or of location data other than traffic data to an extent that exceeds what is necessary for the transmission of a message or for the billing of the telecommunications service; 6. "terminal equipment" means any equipment directly or indirectly connected to the interface of a public telecommunications network for the purpose of sending, processing or receiving messages; in both direct and indirect connections, the connection may be established by wire, optical fibre or electromagnetically; in the case of an indirect connection, a device is interposed between the terminal equipment and the interface of the public network.
