(1) Whoever 1. contrary to section 5(1), intercepts or otherwise takes cognisance of a message, 2. contrary to section 5(2), first sentence, makes a disclosure, or 3. contrary to section 8(1), manufactures or makes available on the market a telecommunications installation named therein, is liable to imprisonment for a term not exceeding two years or to a fine.
(2) Where the offender, in the cases under paragraph 1 no. 3, acts negligently, the penalty is imprisonment for a term not exceeding one year or a fine.
