Material digitalisation projects and communications infrastructures of the Federation

(1) Dedicated information security officers under section 45 must be appointed for the planning and implementation of material digitalisation projects and communications infrastructures of the Federation.
(2) Digitalisation projects or communications infrastructures of the Federation are in particular material where communications technology of the Federation is thereby operated across departments, or serves cross-departmental communication or cross-departmental data exchange.
(3) As a rule, the information security officer under the first sentence is appointed by the entity responsible for steering the digitalisation project or the communications infrastructures of the Federation. Where, in the case of cross-departmental digitalisation projects or communications infrastructures, appointment by entities in various departments and other supreme federal authorities involved comes into consideration, and agreement cannot be reached within a reasonable period as to which entity makes the appointment, the Federal Ministry for Digital Affairs and State Modernisation decides.
(4) The information security officers under the first sentence are subject either to the entity's management or to the respective competent information security officer of the department.
(5) To ensure information security in the planning and implementation of material digitalisation projects, the respective responsible entity should involve the BSI at an early stage and give the BSI an opportunity to comment.
