Principles of electronic handling via administrative portals; substitute for written form

(1) The handling, via an administrative portal under section 2(2), of an electronic administrative service that serves to implement directly applicable legal acts of the European Union for which the Federation has legislative competence, or to implement federal statutes, is carried out in accordance with subsections (2) to (4), unless otherwise provided by federal statute.
(2) Before submitting their declaration, the user must be given the opportunity to check the entire declaration for completeness and accuracy.
(3) The user must be warned, by suitable measures, against submitting the declaration hastily.
(4) After submitting their declaration, a copy of the declaration must be made available to the user for retrieval.
(5) Where the user has, under section 3(4), provided proof of identity via a user account, and submits, via an administrative portal by means of an online form, a declaration for which written form is prescribed by a legal provision, this at the same time satisfies the requirement of written form.
(6) Written form prescribed by a legal provision may, in the case of electronic administrative acts or other electronic documents of the authority transmitted to the mailbox of a user account, also be satisfied by affixing the authority's qualified electronic seal to them.
