Section 43

(1) Destruction of copies or devices may, even in criminal proceedings, be ordered only upon a specific application by the aggrieved party. Withdrawal of the application is permissible until destruction has taken place.
(2) The aggrieved party may pursue destruction of copies or devices independently. In that case, sections 477 to 479 of the Code of Criminal Procedure apply, with the proviso that the aggrieved party may appear as a private prosecutor.
