Section 23

(1) The consent required under section 22 is not needed for the dissemination or display of: 1. portraits from the sphere of contemporary history; 2. images in which the persons appear merely as an incidental feature alongside a landscape or other locality; 3. images of gatherings, processions and similar events in which the persons depicted took part; 4. portraits not produced to commission, provided that their dissemination or display serves a higher interest of art.
(2) This authorisation does not, however, extend to dissemination or display by which a legitimate interest of the person portrayed, or, if that person has died, of their relatives, is infringed.
