(1) Copies unlawfully produced, disseminated or exhibited, and devices intended exclusively for unlawful reproduction or exhibition, such as moulds, plates or stones, are subject to destruction. The same applies to portraits unlawfully disseminated or publicly displayed, and to devices intended exclusively for their reproduction. Where only part of the work has been unlawfully produced, disseminated or exhibited, destruction is to be ordered only in respect of that part and the corresponding devices.
(2) The order for destruction extends to all copies and devices that are the property of persons involved in the production, dissemination, exhibition or display, and of the heirs of such persons.
(3) Destruction is also to be ordered where the production, dissemination, exhibition or display occurred neither intentionally nor negligently. The same applies where production has not yet been completed.
(4) Destruction must take place once it has been finally ordered as against the owner. Insofar as the copies or devices can be rendered harmless otherwise than by destruction, this must be done where the owner bears the costs.
