(1) Any person who carries out acts in trade contrary to Article 13 of Regulation (EU) No 1151/2012 may be sued for injunctive relief if there is a risk of recurrence. This right may also be asserted in the event of the risk of a first-time infringement. The following shall be entitled to the rights in accordance with sentence 1:
1. parties entitled to assert rights in accordance with section 8 (3) of the Act Against Unfair Competition;
2. groups within the meaning of point 2 of Article 3 of Regulation (EU) No 1151/2012;
3. recognised producer organisations, recognised associations of producer organisations and recognised interbranch organisations within the meaning of Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (OJ L 347 of 20 December 2013, p. 671; L 189 of 27 June 2014, p. 261; L 130 of 19 May 2016, p. 18; L 34 of 9 February 2017, p. 41; L 106 of 6 April 2020, p. 12), last amended by Regulation (EU) 2021/2117 (OJ L 435 of 6 December 2021, p. 262), in its applicable version if their objective also includes the protection against infringements referred to in Article 13 of Regulation (EU) No 1151/2012.
Sections 18, 19, 19a and 19c shall apply accordingly.
(2) Section 128 (2) and (3) shall apply accordingly.
