Subsequent extension of protection

(1) The request for subsequent extension of protection of an international registration in accordance with Article 3ter (2) of the Protocol Relating to the Madrid Agreement may be filed with the German Patent and Trade Mark Office. If protection on the basis of a trade mark entered in the Register is to be extended subsequently and if the request is already filed prior to the registration of the trade mark, it shall be deemed to have been received on the date of registration.

(2) The national fee in accordance with the Patent Costs Act for the subsequent extension of protection shall be payable within one month after becoming due (section 3 (1) of the Patent Costs Act).
