Lapse of an investor's tax exemption

(1) Where the conditions for a tax exemption of an investor of an investment fund or a unit class under section 10 cease to exist, the investor is obliged to notify this to the investment fund within one month after the conditions cease to exist. The same applies where an investor transfers its investment units in an investment fund or a unit class under section 10 to another investor.
(2) The tax exemption of an investment fund or a unit class under section 10 lapses to the extent that the conditions for a tax exemption cease to exist for the investment fund's investors, or the investment units are transferred to another investor.
(3) The investor must without delay repay to the investment fund the exemption amounts wrongly granted in the cases of subsection (2).
(4) In the cases of subsection (2), the investment fund must pay the repaid exemption amounts and the exemption amounts not yet paid out, without delay, to the tax authority competent under section 4(1) or (2) no. 1. Where no tax authority is competent under section 4(1) or (2) no. 1, the investment fund must pay the repaid exemption amounts and the exemption amounts not yet paid out, without delay, to the withholding agent.
